The president of the association “For a serene and sustainable mobility” (PMSD), which campaigns against the installation of speed bumps according to him non-compliant, was found guilty of defamation to the prejudice of Hubert Falco and Marc Giraud.
The president of the Toulon Provence Méditerranée metropolitan area (TPM) and the former president of the departmental council had taken legal action following messages posted on Facebook by Thierry Modolo-Dominati, president of PMSD.
This Varois, wealth management advisor, was sentenced to a suspended fine of one thousand euros. He had notably described these local elected officials as “potential criminals”.
Six years of crusade
The PMSD association has been fighting since 2016 to have the character – from its point of view – unregulated, even dangerous, of most speed bumps recognized. So far in vain (proceedings before different jurisdictions are still ongoing).
Defining himself as a “whistleblower” at the hearing of the criminal court held on November 25, Thierry Modolo-Dominati had justified the choice of words used by an objective of “raising consciences”.
“His arguments were not accepted, we now want him to refrain from engaging in smear campaigns“, reacted Me Jean-Claude Guidicelli, to the interests of the former boss of the Department.
